EU throws out Sony BMG merger annulment
Bear with us on this one: the European Court of Justice has thrown out a lower court ruling that annulled the European Commission’s approval of the merger between Sony Music and BMG. ”Since the Court of First Instance examined only two of the five pleas relied on by Impala, the Court of Justice considers that it is not in a position to give a ruling itself on the dispute,” says the court’s statement. “It is accordingly referring the case back to the Court of First Instance.” Although confusing, the news doesn’t have immediate ramifications for Sony BMG - at least until the deal is annulled, approved or both again.
