
The judge in the upcoming retrial of alleged file-sharer Jammie Thomas-Rasset (she’s got married since the original trial, when she was just Jammie Thomas) has thrown out her lawyers’ attempts to bar all MediaSentry evidence from the retrial. What’s more, he’s nixed her attempts to assert a ”fair use” defence. On the latter point, the reason it’s been thrown out is because her lawyers only suggested using this defence a couple of weeks ago, meaning witnesses couldn’t be questioned about it in the deposition and discovery periods. Not the best of starts, it’s fair to say. Well, not if you’re Jammie anyway; presumably the RIAA is pretty chuffed.
