
Here’s a phrase you probably don’t want to hear coming out of your lawyer’s mouth when in the dock for a high-profile file-sharing trial: “We’re admitting liability, your honour”. Yet that’s what was said in court yesterday – albeit not in front of the jury – by one of Joel Tenenbaum’s attorneys. Denied the chance to plead a defence of fair use, it’s looking increasingly likely that Tenenbaum will be found guilty – with speculation shifting to just how big a damages bill he’ll face.
