The latest lawsuit winging its way towards Apple has been filed by New Yorker Robert Herskowitz, who is seeking class-action status for his complaint about being double-charged for an iTunes music download. Herskowitz says he bought Adam Lambert’s Whataya Want from Me in December 2010, and was charged $2.58 instead of $1.29 for the track. GigaOm reports that he complained to Apple, only to be told that the iTunes terms of service dictate no refunds unless a song has failed to download or there have been technical problems.
