One of the challenges to Pandora this year has come from Flo and Eddie, two musicians from the Turtles fighting to get paid digital royalties for songs from before 1972. Now Pandora is pushing back, filing a motion with a California judge to rule that their lawsuits are an illegal restriction on free speech. No, really. The theory here being that the lawsuits (in GigaOm’s words) “could intimidate everyone from radio stations to restaurants from playing popular oldies”. As the piece points out, the “anti-SLAPP” procedures that Pandora wants to use are rarely applied to copyright cases.
